About the possession of the weapon I can say that maybe the author wrote it with general view in mind and about "drop the weapon" I think he just simply does not feel any threats from these thugs or anything, he just pointed them out for the convenience, like how a superhero may just directly skip all that "drop the weapon" thing, now, he is not a "Superhero" but he is a Shield agent who is also trained by Hydra so I think he can handle his own against normal Asgardians, not in strength but in terms of survival.
