To become a heroc spirit he would have to die, yes. As for a contract with Alaya, that is completely unnecessary. That only applies to those who become Counter Guardians like Archer EMIYA, and they are technically not true Heroic Spirits. Real Heroic Spirits are people whose existence are elevated to the Throne of Heroes after death due to their famed deeds in life. Think of a system of worship and belief that empowers or creating gods but on a lesser extent for humans to elevate and become Heroic Spirits.

Solomon made the first modern Thaumatergical Foundation, which was Goetia. Basically he made something for Magic Circuits to work with, as the Foundation is the program for them to execute magecraft with. Before that only those connected to Gods could perform magic, as the Circuits were pretty much only able to transfer information and small things like that. You can see that Magic Circuits already existed like with Circe, who is from the same time as Icarus, as she has them in FGO.
