Well the men weren’t all dead they just left to go to war, and the point of the attack in canon was to kill the last water bender in the water tribe which looking back was a stupid idea. Assuming the Avatar was dead if there are no water benders or they kill the entire South Pole that would leave the North Pole where the next Avatar could be born.
Nonetheless, this was better than what would have happened if Levi wasn't present, in the show most of the men and benders were missing with only women remaining.

Moreover, the production crew and Maurice would not let him off easily. A $50,000 breach of contract fee might not seem much in Hollywood, but it was significant in the industry. It wouldn't be long before he received legal notices or court summons. Even settling out of court would likely cost him a substantial amount.
