Orochimaru was in contention for Fourth and could have gotten it if and only if Hiruzen didn't disagree. Hiruzen himself was chosen to be the Third on the battlefield, no villagers were consulted. Same with Tobirama, Hidden Leaf is not a democracy is my point, the civilian and a majority of the shinobi population are not consulted about who their leaders are.
